Judges and prosecutors deepen their knowledge of the procedure for examining requests for the application and extension of coercive measures
An online workshop on the procedure for examining complaints on the application and extension of coercive measures was organized on 23 February 2022 by the Council of Europe project “Strengthening the human rights-compliant criminal justice system rights in the Republic of Moldova” in cooperation with the National Institute of Justice of Moldova.
50 judges and prosecutors deepened their knowledge on the interpretation and application of legal provisions and relevant requirements of the standards and case law of the European Court of Human Rights (ECHR) in the field of pre-trial detention and house arrest. Participants also learned about the proper application and reasoning of the concept of reasonable suspicion and grounds for continued detention.
Particular attention was devoted to the particularities of the application of pre-trial detention and the procedural conditions for examining requests and issuing the decision on the request for arrest in the context of the Republic of Moldova.
Judgments and decisions of the ECHR on certain cases and practical examples related to the application and extension of coercive measures were presented during the workshop, which allowed professionals to improve their practical skills on the reasoning for the action of applying the constraint measurement procedure.
The workshop discussions were moderated by Council of Europe consultants, Mr Davit Melkonyan (Armenia) and Mr Igor Dolea, (Republic of Moldova).
The online workshop took place within the framework of the Council of Europe project “Strengthening a human rights compliant criminal justice system in the Republic of Moldova”, which is part of the Action Plan of the Council of Europe for the Republic of Moldova for 2021-2024.
